ByRivers Tech LLC (d/b/a WP Tutoring) respects the intellectual property rights of others and expects users of the Service to do the same. We respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. § 512 ("DMCA").

Notices of claimed infringement must be sent to our Designated Agent:

2. Filing a Notice of Infringement

To be effective under the DMCA, your written notice must include substantially the following:

  • (1) A physical or electronic signature of the copyright owner or a person authorized to act on the owner's behalf.
  • (2) Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works).
  • (3) Identification of the material claimed to be infringing, with information reasonably sufficient for us to locate it (e.g., a URL within the Service).
  • (4) Your contact information: name, address, telephone number, and email.
  • (5) A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  • (6) A statement, under penalty of perjury, that the information in the notice is accurate and that you are the owner or authorized to act on the owner's behalf.

Please note that under 17 U.S.C. § 512(f), anyone who knowingly materially misrepresents that material is infringing may be liable for damages, including costs and attorneys' fees.

3. Our Response

Upon receipt of a compliant notice, we will promptly remove or disable access to the identified material, make a good-faith attempt to notify the user who posted it (if applicable), and document the notice.

4. Counter-Notification

If you believe material you posted was removed by mistake or misidentification, you may send our Designated Agent a written counter-notification including:

  • (1) Your physical or electronic signature.
  • (2) Identification of the removed material and its prior location.
  • (3) A statement under penalty of perjury that you have a good-faith belief the material was removed as a result of mistake or misidentification.
  • (4) Your name, address, and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if outside the United States, for any judicial district in which the Company may be found), and that you will accept service of process from the person who filed the original notice or their agent.

If we receive a compliant counter-notification, we may restore the material in 10–14 business days unless the original complainant notifies us that it has filed a court action seeking to restrain the alleged infringement.

5. Repeat Infringers

We will terminate, in appropriate circumstances, the accounts of users who are repeat infringers.
